Authorization and Release of Liability:
I authorize Truedata Recovery Solutions, Inc. to provide data recovery services as needed. I acknowledge that TrueData Recovery Solutions, Inc. and its technicians are not responsible for any data loss related to the data recovery process. I understand that due to the nature of electronic data storage and recovery, issues may arise that are not the fault of TrueData Recovery Solutions, Inc., but rather coincidental, potentially surfacing at any time even if a previous problem is corrected.
Data Recovery Disclaimer:
There is no guarantee that the data specified as “Important Data” will be recovered. Truedata Recovery Solutions, Inc. will make every effort to recover data from the media provided, but successful recovery cannot be guaranteed. Updates will only be provided if there is a problem, if additional information is needed, if the storage media is recovered, or if the media is deemed not recoverable. The completion of recovery is contingent upon the condition of the media.
Warranty and Liability:
All opened items and tested hard drives may void manufacturer warranties. Truedata Recovery Solutions, Inc. is not responsible for encrypted storage media (e.g., ransomware, BitLocker, passwords). Physical damage and encryption are considered separate issues. Additional costs may apply for recovering data from virtual disks or image files stored on physically damaged drives.
Data Transfer and Storage:
All recovered data will be transferred to an external hard drive or flash drive provided or purchased by the customer. If the data is small enough to fit on a 32GB USB stick, it will be provided free of charge. Customers may supply their own blank external hard drive (USB interface only) or flash drive. All storage media will be formatted prior to data transfer.
Payment and Cancellation:
Payment is due in full before the recovered data can be shipped or picked up, unless prior arrangements have been made. If a service quote has been approved, a cancellation fee of 20% of the quoted service fee will apply if the service is canceled. Full payment is required if data is completely recovered and the service is then canceled. Recovered data will be deleted from TrueData’s systems two weeks after it is claimed by the customer, unless otherwise notified.
Equipment and Diagnostic Fees:
Truedata Recovery Solutions, Inc. is not responsible for items left for over 30 days; such items will become the property of TrueData Recovery Solutions, Inc. and will be disposed of to recover shelf space. Diagnostic services are free for all storage media except for RAID drives and mobile devices. Truedata is not responsible for data loss after service completion and data pickup.
Client Confidentiality:
Truedata Recovery Solutions, Inc. agrees to maintain strict client confidentiality. All information, data, and equipment provided to or recovered by TrueData will be deemed confidential and proprietary to the client, and will not be disclosed to any third parties. A non-disclosure agreement is available upon request.
Limitation of Liability:
I agree to hold Truedata Recovery Solutions, Inc., its owners, and technicians harmless for any coincidental damages, including but not limited to business interruption or other liabilities resulting from permanent data loss, data corruption, or delayed delivery of recovered data. To the maximum extent permitted by applicable law, Truedata Recovery Solutions, Inc., its technicians, and officers will not be liable for any direct, indirect, punitive, incidental, special, consequential damages, or any damages whatsoever, including but not limited to damages for loss of use, data, or profits, arising out of or in any way connected with the use or performance of data recovery services. This includes delays or inability to use the recovered data or product of data recovery, provision of or failure to provide services, or otherwise arising from the use of data recovery services, whether based on contract, tort, negligence, strict liability, or otherwise, even if Truedata Recovery Solutions, Inc. or any of its technicians have been advised of the possibility of damages.
